Can a ‘failure to appear’ charge be given for any other reason than not appearing for court?
My dumb a** cousin had a court date today for the final review of a domestic violence case. It looks like he didn’t show cuz the online court record says “FAILED TO APPEAR (FTA)” and “FAIL TO APPEAR CASH WARR ORD” and his ‘party status’ is listed as “WARRANT ORDERED.”
He’s telling those of us in the family that he did go to court and that the judge was unhappy that he’d violated his original probation so they listed it as ‘failure to appear” and issued a warrant. Says he has to turn him self in now and that he’ll do three years for it.
To us, that sounds like BS. Is he telling the truth? Would a judge ever cite failure to appear to someone who in fact appeared? Also, could he really have to do 3 yrs!!!?
